Gerald Eskalin , a renowned musicologist, distills the case to a combination of melody and harmony that are clearly similar. He feels Satriani will say that when melody and harmony are considered in combination, the resulting expression is original and protectable. It all will come down to a musicologists’ opinion as he sees it.
