AIMP After the Panel: Infringement

The April AIMP panel discussion on copyright infringement continues here with AIMP After the Panel questions including opinions on the upcoming and much watched Coldplay / Satriani Vida la Vida case.

Attorney Barry Mallen suggests Coldplay’s lawyers dig for work tapes to show the band’s independent creation
 
Gerald Eskalin , a renowned  musicologist, distills the case to a combination of melody and harmony that are clearly similar. He feels Satriani will say that  when melody and harmony are considered in combination, the resulting expression is original and protectable. It all will come down to a musicologists’ opinion as he sees it.
 
Charles Cronin  feels that Satriani’s attorneys should have educated him on the law and recommended he not pursue the matter….

Charles Cronin, B.A. Oberlin; J.D. American; M.A., Ph.D. Stanford; M.A. Information Systems, Berkeley, is a musician and lawyer. He is a visiting fellow at Yale Law School and developer of the Columbia Law Library Music Plagiarism Project.
Gerald Eskelin – Musicologist has testified on behalf of John Fogerty, Stevie Wonder, Michael Jackson, the Isley Brothers, the Spin Doctors and "Roger Rabbit" composer Allan Sylvestri and provided musicological services for performers including: Janet Jackson, Madonna, Elton John, Faith Hill, Kid Rock, Green Day, and ZZ Top.
Barry Mallen, Esq. defended numerous lawsuits for alleged copyright infringement of musical compositions, including cases involving recording artists such as The Rolling Stones, Mariah Carey, Amy Grant, Ice Cube, Robert Kelly, KISS, The Beastie Boys, Ozzy Osbourne, Kid Rock, Destiny’s Child, Gregg Allman and Kenny Loggins.
