SOLD OUT ::::::: Fair Use and Copyright Abuse: How To Reap Rewards and Avoid Litigation with Dr. E. Michael Harrington

Harrington will discuss current problems that stem from not understanding copyright and copyright protection, as well as important business issues in publishing.  Using numerous audio and visual examples he will answer questions including:


Can copyright protection extend to a bass line?  A chord progression?  The sound and style of a famous artist?


Can two words be protected by copyright?  Can two notes be protected by copyright?  Can three words be protected by copyright?


Is it OK to copy an artist’s sound?  Her style?  Both?

Is it ever OK to sample?


What happens if you are sued for copyright infringement?
When should you sue for copyright infringement?


How does one resolve a copyright dispute?  

How does one resolve a publishing dispute? 

How does one assess a writer’s contribution to a song?


He will also demonstrate real life examples of serious music business mistakes including:

failure to ask permission to use music and/or lyrics


asking permission when it is not necessary


not seeking expert advice regarding copyrighted material


asking the wrong party for permission


not fully understanding the nature of copyright and copyright protection


receiving permission to use copyrighted material but failure to abide by the granted terms of permission


He will play a wide selection of music from many styles and artists including the music of Dr. Dre, Taylor Swift, the Beatles, Lady Gaga, Wiz Khalifa, Elton John, DJ Earworm, the Beastie Boys, Michael Jackson, Henry Mancini, Sting, music from the film Fun With Dick & Jane, television commercials and more.

Dr. E. Michael Harrington teaches entrepreneurship & other courses at the Berklee College of Music, has taught training sessions at Harvard Law School and been on the faculty of Belmont University, UAB and William Paterson.  He is on the Advisory Board of the Future of Music Coalition, a member of Leadership Music and owner of www.emichaelmusic.com .


He has worked as consultant and expert witness in hundreds of music copyright/IP matters for parties including the Dixie Chicks, Steven Spielberg, Steve Perry, Sting, Tupac Shakur, Keith Urban, Ne-Yo and others, delivered lectures at law schools, organizations and universities throughout the U. S., and Canada including Harvard, Yale, GWU, NYU, Boston Bar, Texas Bar, Future of Music Coalition, McGill, Carelton, Experience Music Project and others, and been interviewed by media including the New York Times, Wall Street Journal, Bravo, CNN, the “Today Show,” Time, Huffington Post, Inc Magazine, Bio Channel, Ovation, NPR, AP, Salon, PC Magazine, Billboard, PBS, Canadian Public Radio and others.
